Preamble

SEM Eurométropole Metz Habitat (SEM EMH) is committed to a continuous and dynamic approach to ensuring compliance with Regulation No. 2016/679, known as the General Data Protection Regulation (GDPR), and Law No. 78-17 of January 6, 1978, relating to data processing, files, and individual liberties, in its amended version, regarding the data processing carried out on its website.

As part of this commitment, SEM EMH aims to inform you more precisely about how your personal data is used and about your rights through this Policy.

  • “Authorized Third Party” – authorities which, by virtue of legislative and regulatory provisions, have the power to request that a data controller transmit documents or information containing personal data.

For What Purposes Do We Process Your Data?

1. Management of the Website

a. Management of Website Services and Features

When you browse our website, Eurométropole Metz Habitat processes your data in order to manage the services and features of the site, based on its legitimate interest in ensuring that it functions properly and carries out normal administrative operations.

The data involved consists of technical information such as the type of internet browser, the operating system used, the domain name of your internet service provider, and your IP address (anonymized). This information is necessary to properly display the web pages you request. Our digital department may technically have access to this data but is not required to consult it.

If you provide information via our contact form, Eurométropole Metz Habitat processes your data to receive and handle your requests based on its legitimate interest in addressing submitted requests.

The data involved includes your identity (name, first name, contact details), information concerning your request, and any other data pertaining to our discussions. Recipients of this data include the internal services of Eurométropole Metz Habitat, notably your local agency (contact form), our human resources department (recruitment forms), our administrative and financial department (SLS/OPS), and our commercial department (sales, Edouard Branly Residence).

Your data will be kept for as long as is necessary to process your request, which will be handled as promptly as possible.

2. Management of Other Forms

a. Management of Job Applications

As part of your job application (unsolicited or for a specific vacancy) via our dedicated form, Eurométropole Metz Habitat processes your data based on our legitimate interest in receiving and examining your application.

The data involved includes your identity (name, surname, contact details), information relating to your skills and professional experience (CV, cover letter, diploma(s)), and any other data stemming from our communications.

Recipients of this data include the Human Resources department of Eurométropole Metz Habitat and authorized personnel of the subsidiary concerned by the job offer.

If the recruitment process is successful, your data will be entered into your administrative file and kept for the duration applicable to that file, i.e., up to five (5) years after the end of the employment relationship. In order to finalize the recruitment, the HR department may share some of the information collected with organizations informed of your hiring (particularly unemployment insurance, health insurance, retirement, mutual insurance).

If rejected, your data will be deleted six (6) months after the end of the recruitment process or from the time the position is filled. With your prior consent, we will retain your information in our CV database for a period not exceeding two (2) years from your last contact, in case a future position might be suitable for you.

b. Management of SLS/OPS Surveys

In the context of SLS and OPS surveys, you may submit your documents via a dedicated contact form. The data involved includes your identity, your family composition, and your tax information.

The recipients of this data are strictly internal, specifically the tenant management service within our administrative and financial department, so that your information may be updated in our internal software and, if necessary, your rent can be adjusted. The documents are uploaded to our internal system and removed from our website every month. All necessary precautions are taken to ensure that only authorized members of the service can view these records in our internal network. Our digital department maintains technical access to submissions to ensure the IT process functions properly, but does not consult the attachments.

c. Management of Student Housing Requests (Edouard Branly Residence)

When you request student housing through the Edouard Branly Residence website (https://edouardbranly.eurometropolemetzhabitat.fr/), your documents and information are only sent via email to the Edouard Branly Residence management team so that they can process your request and propose suitable housing.

The recipients of this data are strictly internal and comprise the Residence management team. Documents are sent exclusively by email, without being saved on our web server.
Our digital department retains technical access to submissions to ensure the process works properly, but does not view the attachments.

d. Management of Requests to Update Contact Details for Virtual Agency Registration

When you request an update to your contact details in order to register with the Virtual Agency (https://www.eurometropolemetzhabitat.fr/locataires/decouvrir-lagence-virtuelle/inscription-agence-virtuelle/), your information is only emailed to the relevant local agency that you have selected. Your new contact details will then be updated in our internal management software in order to invite you to your personal online account.

The recipients of this data are strictly internal. Our digital department has technical access to submissions to ensure proper functionality of the process, but does not open the attachments.

e. Management of the Online Payment Form

Eurométropole Metz Habitat offers a secure online platform (https://jepaieenligne.systempay.fr/OPHMM) for paying your rent. Our organization informs you that the data you enter is required in order to pay your rent by credit card.

Payment is made directly on the Caisse d’Épargne platform. All your banking transactions are carried out on secure servers using encrypted Secure Socket Layer (SSL) and 3D Secure protocols. Neither the organization you wish to pay nor any internet user will have access to your banking details. Once the transaction is complete, you will receive a confirmation email summarizing the details of your payment. The beneficiary (the company, local authority, association, or works council) is also notified that your payment has been received.

4. Managing Personal Data Rights Requests

In accordance with our legal and regulatory obligations, Eurométropole Metz Habitat processes your data in order to manage your requests to exercise your personal data rights.

The data in question includes your identity (name, first name, contact details) and data related to your rights requests (the nature of the request, subsequent actions taken).
Recipients of this data include the person responsible for handling such requests and the authorized personnel
of the subsidiary concerned by your request.

Your data is kept for a maximum of five (5) years from the date your request is closed.

Who Can Access Your Data?

Depending on the processing in question, the recipients of your data may be:

  • Internal recipients: Authorized services within Eurométropole Metz Habitat (notably our human resources department for recruitment, our administrative and financial department for SLS/OPS, our territory and commercial management department which includes local agencies for inquiries and sales,
    and our digital department may technically access this data but does not necessarily consult it).
  • Authorized Third Parties: In accordance with current regulations, your personal data may be transmitted to authorities authorized by law or regulation to require the transmission of documents or information containing personal data. When Eurométropole Metz Habitat receives such a request, we take the necessary steps to verify its validity.
  • Processors: Eurométropole Metz Habitat uses data processors for managing its website. In such cases,
    we ensure that they provide sufficient guarantees regarding the implementation of appropriate technical and organizational measures.

How Do We Secure Your Data?

Eurométropole Metz Habitat undertakes to make every effort to implement organizational and technical measures appropriate to the sensitivity of the data and the risks to users, in accordance with Article 32 of the GDPR.

However, it is each user’s responsibility to ensure the security of any personal data transmitted via the internet. Eurométropole Metz Habitat cannot be held liable for personal data transmitted via the internet.

Most of the contact forms on this website do not store the information or documents on our server; rather, they function as regular email exchanges (your data is sent directly by email to the relevant teams without being recorded electronically).

Transfer of Data Outside the European Union

Eurométropole Metz Habitat does not transfer personal data outside the European Union. In any event, we undertake not to transfer personal data to a country located outside the European Union without first informing users.

How to Exercise Your Rights and Who to Contact

In accordance with the GDPR, you may, depending on the situation, exercise the following rights regarding your data: the right of access, the right to rectification, the right to object, the right to erasure, the right to restrict processing, the right to data portability, and the right to withdraw your consent.
